These General Terms and Conditions are based on the standard terms and conditions of the Belgian Chamber of Removers (BKV/BCR - Belgische Kamer van Verhuizers / Chambre Belge des Déménageurs), April 2025 edition. Gorgan Move BV is a member of BKV/BCR.

1. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • Customer: Any natural or legal person who enters into an agreement with Gorgan Move BV for removal, lift, or storage services. This includes both Business Customers and Consumers.
  • Business Customer: A Customer who is not a Consumer, including companies, organizations, governmental institutions, and professionals acting within their trade or business capacity.
  • Consumer: A natural person acting for purposes outside their trade, business, craft, or profession, as defined by Article I.1, 2° of the Belgian Code of Economic Law.
  • SME (Small and Medium-sized Enterprise): Companies meeting the criteria defined in Article 1:24, section 1 of the Belgian Companies and Associations Code.
  • Goods: All movable items that are the subject of the service agreement.
  • Working Days: All calendar days except Sundays and legal public holidays in Belgium. Any term ending on a Saturday is extended to the following Working Day.
  • Removal: The transport of Goods from one location to another, including loading, unloading, and related services as agreed.
  • Storage/Safekeeping: The professional storage of Goods in our facilities, where Gorgan Move BV accepts custody and care of the stored items.
  • Self-Storage: The provision of storage space where the Customer retains custody and responsibility for their stored Goods.
  • Lift Service: The provision and operation of a furniture lift/hoist for moving Goods through windows or balconies.
  • Inventory List: A document listing all Goods to be moved or stored, signed by both parties.

2. Scope and Applicability

2.1 Application

These General Terms and Conditions apply to all offers, quotations, agreements, and services provided by Gorgan Move BV, including:

  • National removals (within Belgium)

  • International removals (from/to Belgium)

  • Business removals

  • Lift services

  • Storage/safekeeping services

  • Self-storage services

2.2 Acceptance

By signing a quotation, purchase order, or service agreement, the Customer accepts these Terms and Conditions in full. The Customer thereby renounces the application of any of their own general terms and conditions.

2.3 Priority of Documents

In case of conflict between the specific service agreement/quotation and these General Terms and Conditions, the specific service agreement/quotation shall prevail.

2.4 Expatriate Customers

Customers whose removal is contracted and/or paid for by their employer are considered Business Customers and do not benefit from Consumer protection provisions.

2.5 Consumer Right of Withdrawal

For Consumers Only: For contracts concluded remotely (online, by phone, or email) or off-premises, Consumers have the right to withdraw from the agreement within 14 calendar days from the date the contract is concluded, without providing any reason.

Exceptions: The right of withdrawal does not apply when:

  • The service has been fully performed at the Consumer's explicit request before the withdrawal period expires

  • The Consumer has expressly agreed that performance may begin before the withdrawal period ends and acknowledges losing the withdrawal right upon full performance

To exercise the withdrawal right, the Consumer must inform Gorgan Move BV by unequivocal statement (by post or email). If withdrawal is exercised, all payments will be refunded within 14 calendar days. The Consumer must pay a proportionate amount for services already delivered.


3. Residential Removal Services

3.1 Scope of Services

Our residential removal services include:

  • Receiving Goods at the agreed place and time

  • Professional loading and securing of Goods

  • Transport to the destination

  • Unloading and placement of Goods

  • Assembly and disassembly of furniture (if agreed in writing)

  • Provision and collection of packing materials (if agreed)

3.2 Customer Obligations

The Customer must:

Before the Removal:

  • Complete and return the inventory checklist accurately and completely

  • Provide an implantation/floor plan at least 3 working days before the removal

  • Disclose any valuable items requiring special treatment (antiques, art, fragile items)

  • Inform us of heavy or oversized items requiring special equipment

  • Provide accurate information about loading and unloading addresses

  • Inform us of any factors affecting accessibility (public works, narrow streets, low-hanging branches, stairs, lift availability, parking restrictions)

  • Arrange parking permits and reserved spaces for our vehicles (costs borne by Customer)

  • Ensure Goods are not subject to any legal seizure or dispute

During the Removal:

  • Be present (or have an authorized representative present) throughout the entire removal process

  • Ensure nothing is left behind at the departure address

  • Personally transport jewelry, cash, important documents, and items of sentimental value

3.3 Goods Excluded from Removal

The following items are excluded from our removal services:

Absolutely Prohibited:

  • Narcotics and illegal substances

  • Weapons and ammunition

  • Live animals and plants

  • Hazardous materials (explosives, flammable liquids, corrosives, radioactive materials)

  • Perishable goods

  • Items prohibited by law in the origin or destination country

Require Prior Written Agreement:

  • Items requiring special permits or authorizations

  • Extremely heavy items (safes, machinery over 300kg)

  • Pianos and grand pianos

  • Items of extraordinary value exceeding EUR 10,000

Customer Responsibility: All risks, penalties, and damages arising from undisclosed prohibited items are borne by the Customer, who shall indemnify Gorgan Move BV against any third-party claims.

3.4 Valuable Items

Items of exceptional value (jewelry, precious metals, securities, collectibles, artwork valued over EUR 5,000) must be:

  • Declared in writing at least 3 working days before the removal

  • Listed in a detailed inventory

  • Specially packaged and secured

  • Transported separately at an additional cost (with Customer consent)

3.5 International Removals - Customs

For international removals, the Customer must:

  • Provide all necessary customs and immigration documents at least 3 working days before departure

  • Appear personally before customs authorities if required

  • Bear full responsibility for the accuracy of all information provided

  • Pay all customs duties, import taxes, and related charges

4. Business Removal Services

4.1 Scope of Services

Business removal services include all services listed in Section 3.1, plus:

  • Development of removal plans

  • IT equipment handling (servers, computers, networking equipment)

  • Archive packing and handling

  • Furniture assembly systems

  • Installation of projectors, screens, and AV equipment (upon request)

  • Fitted carpet removal and laying (upon request)

  • Workspace setup and configuration

4.2 Additional Business Customer Obligations

In addition to the obligations in Section 3.2, Business Customers must:

  • Provide a detailed location/floor plan for each destination room

  • Number all destination rooms clearly

  • Ensure exclusive lift access during the removal period

  • Provide specifications for IT and special equipment

  • Coordinate with their IT department for server and network disconnections

  • Inform us of building management rules and access procedures

4.3 Working Hours and Overtime

Standard working hours are Monday to Friday, 08:00 - 17:00.

Overtime rates apply for:

  • Work requested outside standard hours

  • Weekend work (Saturday and Sunday)

  • Public holiday work

  • Extended hours due to Customer-caused delays

5. Lift Services

5.1 Service Description

Our lift service consists of:

  • Transport and placement of the furniture lift

  • Operation of the lift by our trained operator

  • Standard operation duration as specified in the quotation

Important: Gorgan Move BV is responsible only for the operation of the lift. The Customer is responsible for:

  • Correct placement and attachment of Goods on the lift platform

  • Ensuring Goods do not exceed the maximum lifting capacity or platform dimensions

5.2 Customer Obligations for Lift Services

The Customer must ensure:

  • Sufficient passage for lift delivery and placement (minimum 3.5m clearance height)

  • Stable, level ground for lift placement

  • Two free parking spaces directly under the window opening

  • Windows or balcony doors can accommodate the Goods

  • No overhead cables or obstructions in the lift path

  • Building facade can support the lift during operation

  • Necessary permits and parking reservations are obtained

5.3 Safety Rules

Platform Safety: Under no circumstances may any person enter or stand on the lift platform. Violation of this rule releases Gorgan Move BV from all liability for personal injury.

Weather Conditions: The lift operator may suspend or cancel the service if weather conditions (high winds, storms, lightning) make operation unsafe. No compensation is due in such cases.

5.4 Cancellation by Operator

If our operator determines that the lift service cannot be safely performed due to:

  • Inaccessible location

  • Unsuitable building structure

  • Dangerous weather conditions

  • Goods exceeding safe lifting parameters

The service may be cancelled without compensation. Reasonable costs already incurred may be charged.


6. Storage Services (Safekeeping)

6.1 Nature of Agreement

Our safekeeping service is a professional storage contract where Gorgan Move BV:

  • Accepts custody and care of the stored Goods

  • Stores Goods in clean, dry, secure facilities

  • Returns Goods upon the Customer's request

6.2 Commencement of Storage

The storage agreement takes effect when:

  • Goods have physically arrived at our storage facility

  • An inventory list has been completed and signed by both parties

6.3 Access to Stored Goods

  • Customers may access their stored Goods by appointment during business hours

  • A Gorgan Move BV representative will accompany the Customer

  • The inventory will be updated following any access

6.4 Customer Obligations for Storage

The Customer must:

  • Pack all Goods properly in suitable packaging

  • Seal, lock, or close all packages securely

  • Dismantle lighting fixtures and pack components separately

  • Pack wines and non-hazardous liquids separately

  • Provide a valid contact address and notify us of any changes

6.5 Prohibited Items in Storage

The following may not be stored:

  • Perishable goods

  • Hazardous, flammable, or explosive materials

  • Items that could damage other stored Goods

  • Living organisms (including plants)

  • Weapons and ammunition

  • Items requiring special permits (unless proof is provided)

6.6 Motor Vehicles in Storage

For vehicle storage:

  • Customer must provide a protective tray for fluid leaks

  • Fuel must be reduced to the minimum practical level

  • Battery must be disconnected

6.7 Termination of Storage

By Customer: The Customer may terminate with 1 month written notice.

By Gorgan Move BV: We may terminate with 2 months written notice for:

  • Business discontinuation

  • Circumstances making continued storage unreasonable

Upon termination, Goods must be collected before the notice period expires. After expiry, storage fees continue until Goods are collected.


7. Self-Storage Services

7.1 Nature of Agreement

Self-storage is fundamentally different from safekeeping:

  • Gorgan Move BV provides storage space only

  • This is NOT a rental, custody, or warehouse agreement

  • The Customer retains full custody and responsibility for stored Goods

  • Gorgan Move BV has no obligation to preserve, guard, maintain, or monitor stored items

7.2 Duration

  • Minimum duration: 1 month (unless otherwise agreed)

  • After the minimum period, the agreement continues indefinitely

  • Either party may terminate with 14 working days written notice

7.3 Customer Responsibilities

The Customer must:

  • Use and maintain the storage space with due diligence

  • Keep the space locked at all times when not present

  • Return the space in its original condition, clean and tidy

  • Not conduct any business activities from the storage space

  • Not establish a registered address at the storage location

  • Not sublet or transfer access rights without written consent

  • Report any damage to the space within 24 hours

7.4 Prohibited Items in Self-Storage

In addition to items listed in Section 6.5:

  • Toxic chemicals and radioactive substances

  • Gas cylinders and batteries

  • Fireworks and explosives

  • Vehicle wrecks

  • Cash and securities

  • Furs, jewelry, artwork, and irreplaceable items

  • Items exceeding 250 kg/m² floor density

7.5 Access by Gorgan Move BV

Gorgan Move BV has no routine access to the storage space. Access may occur only:

  • In emergencies (fire, flooding, security threats)

  • With at least 14 calendar days notice for maintenance

  • If illegal activity is suspected (authorities may be granted access)

7.6 Insurance Requirement

Mandatory: Self-storage Customers MUST maintain insurance covering:

  • Fire, explosion, water damage, theft, and other damage to stored Goods

  • Third-party liability for damage caused by stored items

Proof of insurance (policy copy and premium payment receipt) must be provided at contract signing.


8. Pricing and Quotations

8.1 Quotation Basis

Our quotations are based on:

  • Volume and/or weight of Goods (as declared by Customer)

  • Distance and destination

  • Estimated duration

  • Information provided by the Customer

8.2 Validity

Quotations are valid for 30 calendar days unless otherwise specified.

8.3 VAT Treatment

  • Business Customers: VAT is NOT included in quoted prices

  • Consumers: VAT IS included in quoted prices

8.4 Price Adjustments

Gorgan Move BV may adjust prices for factors beyond our control, including:

  • Changes to collective labor agreements

  • Legislative or regulatory changes

  • Fuel and energy cost fluctuations

  • Changes in material, equipment, or transport costs

  • Exchange rate variations (for international removals)

  • Subcontractor price changes

Consumer Protection: If a price increase occurs more than 3 months after contract conclusion, Consumers may terminate the agreement free of charge.

8.5 Annual Storage Fee Adjustment

For ongoing storage agreements:

  • Safekeeping: Fees may be adjusted annually after the first year

  • Self-Storage: Fees may be adjusted 6 months after commencement, then annually on January 1st using the Belgian Consumer Price Index

8.6 Supplementary Costs

The following costs are not included in standard quotations and will be charged separately:

  • Overtime work

  • Additional services requested during execution

  • Costs arising from inaccurate Customer information

  • Customs duties and import taxes

  • Parking fines due to Customer's failure to arrange permits

  • Waiting time due to Customer delays

  • Additional packaging materials used

8.7 Actual Volume/Weight

If the actual volume or weight of Goods exceeds the quoted estimate by more than 10%, the price will be recalculated based on actual measurements at our standard rates.


9. Payment Terms

9.1 Invoice Protest

Invoices are deemed accepted unless a reasoned written protest is submitted within 8 calendar days from the invoice date.

9.2 Payment Deadline

All invoices are payable within 14 calendar days from the invoice date, unless otherwise agreed in writing.

9.3 Advance Payment

National Removals: We may require an advance payment before commencing services.

International Removals: Full payment may be required at least 7 calendar days before the Goods depart Belgium.

Storage Services: A deposit of up to 3 months' storage fees may be required upon commencement.

9.4 Late Payment - Business Customers

In case of late payment, the following apply automatically without prior notice:

  • Interest on arrears: 10% per annum on the outstanding amount

  • Administrative costs: 10% of the outstanding amount (minimum EUR 150)

  • All other outstanding amounts become immediately payable

  • Gorgan Move BV may suspend all services without liability

9.5 Late Payment - Consumers

In case of late payment:

  • A free reminder will be sent

  • The Consumer has an additional 14 days (if sent by email) or 17 days (if sent by post) to pay

  • No interest accrues during this grace period

  • After the grace period, the following apply:

- Late payment interest as per the Act of 2 August 2002
- Fixed compensation:
- Amounts up to EUR 150: EUR 20
- Amounts from EUR 150.01 to EUR 500: EUR 30 + 10% of the amount
- Amounts over EUR 500: EUR 65 + 5% of the amount (maximum EUR 2,000)

9.6 Consequences of Non-Payment

In case of non-payment despite reminders, Gorgan Move BV may:

  • Suspend delivery of Goods

  • Deny access to storage space

  • Exercise retention rights over Goods

  • Initiate sale of Goods to recover amounts owed (see Section 9.8)

9.7 Right of Retention

Gorgan Move BV has the right to retain all Goods in its possession until the Customer has fulfilled all payment obligations, including:

  • Outstanding invoices

  • Interest and administrative costs

  • Any other amounts owed under any agreement

9.8 Right of Lien (Pledge)

For Business Customers:
If payment is not received after a formal notice with 10 working days to pay (3 days for perishable goods), Gorgan Move BV may:

  • Arrange for the sale of Goods through a bailiff

  • Purchase the Goods itself

  • Apply proceeds to the outstanding debt

For Consumers:
Sale of Goods requires prior court approval. Gorgan Move BV may not purchase the Goods itself.

9.9 Uncollected Goods

If Goods are not collected after termination of a storage agreement:

  • From the second calendar day after our written request, we may charge the standard storage fee plus 25%

  • If uncollected after 2 months following written notice, Goods may be sold or disposed of

  • Sale proceeds are applied first to our claim; any surplus is held for the Customer

10. Cancellation Policy

10.1 Cancellation by Customer - Removal and Lift Services

Cancellation must be made in writing. The following compensation applies based on timing before the scheduled service date:

10.2 Cancellation by Customer - Storage Services

| 1 to 3 days | 75% of one month's storage fee |
| Less than 24 hours | 100% of one month's storage fee |

10.3 Postponement

If the Customer requests postponement:

  • All costs and damages caused by the postponement are borne by the Customer

  • If postponement is not feasible without disrupting our operations, it will be treated as a cancellation

  • If postponement exceeds 2 months without a new date agreed, the agreement is deemed cancelled

10.4 Cancellation by Gorgan Move BV

We may terminate the agreement immediately and without compensation in case of:

  • Customer's death, bankruptcy, or liquidation

  • Failure to pay invoices after 14 days written notice

  • Discovery of undeclared prohibited items

  • Customer's failure to fulfill essential obligations

11. Liability and Insurance

11.1 Gorgan Move BV's Liability - General

We are liable for:

  • Loss or damage to Goods caused by our fault during performance of services

  • Damage to buildings at loading/unloading locations caused by our operations

  • Delays caused by our fault

We are NOT liable for:

  • Force majeure events (see Section 13)

  • Acts of third parties beyond our control

  • Damage attributable to the Customer or their representatives

  • Goods packed by the Customer or third parties (we are only liable for external condition)

11.2 Limitation of Liability

Maximum Liability: Our liability is limited to EUR 125 per cubic meter of lost or damaged Goods.

Business Removals: An additional exemption of EUR 750 per removal order applies to the total claim.

This limitation does not apply in cases of intent, gross negligence, or willful misconduct by Gorgan Move BV.

11.3 Exclusion of Indirect Damages

Gorgan Move BV is never liable for indirect or consequential damages, including:

  • Loss of profit or revenue

  • Loss of data

  • Business interruption

  • Reputational damage

  • Loss of goodwill

  • Anticipated savings not realized

This exclusion does not apply in cases of intent, gross negligence, or willful misconduct.

11.4 Liability for Delay

Our Liability: We are liable for delays of 30 minutes or more caused by our fault (excluding force majeure). We will inform the Customer immediately of any anticipated delays.

Customer's Liability: The Customer is liable for delays of 30 minutes or more caused by their failure to be ready for loading/unloading. Additional costs will be charged at our standard rates.

11.5 Special Liability Provisions - Lift Services

In addition to the above:

  • We are not liable for damage caused by incorrect placement or attachment of Goods by the Customer

  • We are not liable for damage caused by Goods exceeding platform capacity

  • We are not liable for minor or unavoidable damage from normal lift operation

  • We are not liable for damage due to pre-existing facade instability

  • We are never liable for personal injury resulting from improper lift use

11.6 Special Liability Provisions - Storage

In addition to the above:

  • We are not liable for damage from vermin (unless proven to be our fault)

  • We are not liable for damage arising from the nature of the Goods or hidden defects

  • We are not liable for deterioration of organic materials, oxidation of metals, or damage to delicate items (clocks, musical instruments, electronics)

11.7 Special Liability Provisions - Self-Storage

For self-storage services, liability is significantly limited:

  • We do not act as custodian or security guard

  • Our liability cannot exceed the storage fee paid for one year (or the actual contract period if shorter)

  • We are not liable for theft or damage caused by third parties

  • We are not liable for activities of other customers

11.8 All-Risk Insurance

Given our limited liability, we strongly recommend that Customers obtain "All-Risk" insurance covering the full replacement value of their Goods.

Insurance Options:

  • Through Gorgan Move BV: At the Customer's explicit request, we can arrange coverage through our insurance broker, covering theft, damage, loss, and fire.

  • Customer's Own Insurance: The Customer may arrange their own policy, which must include a "waiver of recourse" in favor of Gorgan Move BV (except for intentional fault or gross negligence).

No Written Instruction: If the Customer does not provide explicit written instructions to arrange insurance, Gorgan Move BV assumes the Customer has self-insured or does not wish coverage.

Without Insurance: Compensation is limited to the amounts specified in Section 11.2.


12. Damage Reporting and Complaints

12.1 Reporting Visible Damage

Visible damage must be reported immediately at the time of delivery on the delivery document, following joint inspection with our staff.

Failure to report visible damage at delivery creates a presumption that Goods were received in the condition they were handed over.

12.2 Reporting Non-Visible (Hidden) Damage

Non-visible damage must be reported by email or registered letter within 3 working days following delivery (excluding the delivery day).

12.3 Reporting Delay Damage

Claims for damage caused by delay must:

  • Prove that damage actually occurred as a result of the delay

  • Be submitted in writing within 2 working days after delivery

12.4 Burden of Proof

The Customer bears the burden of proving:

  • That damage or loss occurred

  • The extent of the damage or loss

  • That Gorgan Move BV is liable for such damage or loss

12.5 Statute of Limitations

Removal and Lift Services: All claims against Gorgan Move BV become time-barred 1 year after the determination of the damage or the invoice date.

Storage Services: All claims become time-barred 6 months from the date the Goods were returned.

12.6 No Suspension of Payment

The Customer may not suspend payment of amounts owed to Gorgan Move BV based on claimed losses, damages, or delays, unless such claim is indisputably certain, liquid, and due.

12.7 Compensation Payment

Compensation payable by Gorgan Move BV will be paid within 14 calendar days after a discharge is issued and the claim is accepted.


13. Force Majeure

13.1 Definition

Force majeure refers to circumstances beyond the reasonable control of a party that make fulfillment of obligations impossible, and which are both unforeseeable and unavoidable.

13.2 Examples of Force Majeure Events

The following are considered force majeure events (non-exhaustive):

  • War, armed conflict, revolution, civil unrest

  • Acts of terrorism, sabotage, riots

  • Strikes and labor disputes

  • Government measures and orders

  • Pandemic, epidemic, quarantine, lockdown

  • Fire, explosion, natural disasters

  • Severe weather (storms, flooding, lightning, tornado)

  • Border closures and customs delays

  • Transport network failures

  • Cyber attacks affecting essential systems

  • Energy restrictions or shortages

13.3 Consequences

Temporary Impediment:

  • Performance obligations are suspended for the duration of the impediment

  • The performance period is automatically extended

  • No compensation is due for the delay

  • Payment obligations remain in force

Permanent Impediment:

  • Either party may terminate the agreement without liability for damages

  • Termination requires 10 working days written notice

13.4 Notification

The party affected by force majeure must notify the other party in writing within 5 working days of becoming aware of the event.


14. Data Protection

14.1 GDPR Compliance

Gorgan Move BV complies with the General Data Protection Regulation (EU) 2016/679 (GDPR) and all applicable Belgian data protection laws.

14.2 Data We Process

We process the following personal data:

  • Identification data (name, address, date of birth)

  • Contact details (phone, email, postal address)

  • Information about Goods being moved or stored

  • Loading and unloading addresses

  • Payment information

14.3 Purposes of Processing

Personal data is processed for:

  • Performance of our service agreements

  • Customer administration and communication

  • Invoicing and accounting obligations

  • Dispute management and legal claims

  • Compliance with legal obligations

14.4 Data Security

We implement appropriate technical and organizational measures to protect personal data. Access to personal data is limited to employees who need it for their functions.

14.5 Customer Rights

Customers have the right to:

  • Access their personal data

  • Request correction of inaccurate data

  • Request deletion of data (where legally permitted)

  • Object to certain processing activities

  • Receive their data in a portable format

15. Applicable Law and Jurisdiction

15.1 Governing Law

All agreements with Gorgan Move BV are governed exclusively by Belgian law.

15.2 Jurisdiction - Business Customers

Disputes with Business Customers shall be submitted to the courts of Leuven (the district where Gorgan Move BV has its registered office).

15.3 Jurisdiction - Consumers (Belgium)

For Belgian Consumers, disputes shall be submitted to the courts of the district where the Consumer is domiciled, or to the courts of Leuven at the Consumer's choice.

15.4 Jurisdiction - International Consumers

For Consumers residing outside Belgium, jurisdiction is determined by EU Regulation 1215/2012 on jurisdiction and the recognition and enforcement of judgments.

15.5 Severability

If any provision of these Terms and Conditions is declared unlawful, invalid, or unenforceable:

  • The remaining provisions shall continue in full force

  • The parties shall negotiate in good faith to replace the invalid provision with a valid provision of similar economic effect

For Consumers: Pursuant to Article VI.84 of the Belgian Code of Economic Law, unlawful terms are prohibited and void. The agreement remains binding if it can continue without the unlawful terms.
